Terms of Service

1. Acceptance of Terms

By making a reservation, paying a deposit, or boarding The Vibe (our 24-foot pontoon boat), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not proceed with your booking.

These Terms apply to all customers, guests, and any person who boards the vessel as part of your reservation.

2. Rental Description

Floating Vibes Rentals offers recreational pontoon boat rentals under the following packages:

4-Hour Rental – $500
8-Hour Rental – $800

Operating hours are 9:00 AM to 9:00 PM daily. The vessel accommodates a maximum of 11 passengers.

Available add-ons include: KTV/karaoke setup, Bluetooth speaker, cooler rental, fishing gear, and captain/guide service. Add-ons are subject to availability and additional fees.

3. Reservations & Payment

Reservations must be made at least 2–3 days in advance. All bookings are confirmed only upon receipt of the required deposit.

Full payment details and deposit requirements will be provided at the time of booking. By completing payment, you confirm that you have read and agreed to these Terms.

Prices are subject to change without notice. The rate confirmed at time of booking will be honored for that reservation.

4. Cancellation & Refund Policy

We understand that plans change. Our cancellation policy is as follows:

Cancellations made at least 48 hours before the scheduled rental time are eligible for a full refund.
Cancellations made less than 48 hours before the scheduled rental time will receive a 50% refund only.
No-shows (failure to appear at the designated meeting point without prior notice) are non-refundable.

Floating Vibes Rentals reserves the right to cancel or reschedule any booking due to adverse weather conditions, mechanical issues, or other circumstances beyond our control. In such cases, customers will be offered a full refund or a reschedule at no additional charge.

5. Safety Rules & Customer Responsibilities

The safety of all passengers is our top priority. By accepting these Terms, all customers and their guests agree to the following:

All passengers must follow instructions from the captain or Floating Vibes Rentals staff at all times.
Life jackets are available onboard and must be worn by non-swimmers and minors.
No diving, jumping off the vessel, or reckless behavior that endangers passengers or the boat.
Alcohol consumption is permitted in moderation; intoxicated individuals may be denied boarding or removed for safety.
Swimming is only permitted in designated areas and with captain approval.
Passengers must remain seated or hold on while the vessel is in motion.

Floating Vibes Rentals reserves the right to terminate a rental at any time if safety rules are violated, without refund.

6. Maximum Capacity

The vessel has a strict maximum capacity of 11 passengers. No exceptions will be made. Exceeding the capacity limit is a violation of maritime safety regulations and these Terms. Customers who attempt to board more than 11 passengers will have the excess guests denied boarding without refund of any portion of the rental fee.

7. Liability & Waiver

Participation in boat rental activities involves inherent risks, including but not limited to: weather conditions, water hazards, equipment malfunction, and the actions of other people.

By proceeding with a reservation, you voluntarily assume all risks associated with the rental and release Floating Vibes Rentals, its owners, employees, and agents from any and all claims, damages, liabilities, losses, or expenses arising from your participation, to the fullest extent permitted by applicable law.

Floating Vibes Rentals shall not be held liable for injuries, loss of life, theft, or damage to personal property, unless caused directly by our gross negligence.

8. Damage to Property

Customers are responsible for any damage to the vessel, equipment, or add-ons caused by misuse, negligence, or failure to follow instructions. The cost of repair or replacement will be assessed and charged to the responsible party.

Floating Vibes Rentals is not responsible for any personal belongings lost, stolen, or damaged during the rental period. Customers are advised to secure valuables.

9. Conduct & Prohibited Activities

The following are strictly prohibited during the rental:

Illegal activities of any kind
Bringing prohibited substances onboard
Harassment, threatening behavior, or physical altercations
Tampering with or operating the vessel without authorization
Excessive noise that disturbs other waterway users
Littering or disposing of waste in the water

Violation of any prohibited activity may result in immediate termination of the rental, removal from the vessel, and/or reporting to authorities. No refund will be issued in such cases.

10. Minors

Guests under 18 years of age must be accompanied by a parent or legal guardian at all times. The accompanying adult assumes full responsibility for the minor's behavior and safety during the rental period.

11. Identification Requirements

A valid government-issued ID is required at the time of boarding for the primary booking contact. Floating Vibes Rentals reserves the right to verify identities and deny boarding to any person who cannot provide valid identification.

12. Changes to These Terms

Floating Vibes Rentals reserves the right to update or modify these Terms at any time without prior notice. The most current version will be published on our website. Continued use of our services after any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in South Florida.
